Terms of Service

These Terms of Service (“Terms”) govern your access to and use of our services, including the website, desktop application, APIs, and any related features (collectively, the “Service”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Our Service

We provide a streaming-companion bot (“Mobe”) that listens to your stream and responds according to the logic or configurations you set. You retain full control of your stream and your data (see Section 4).

We may update, suspend, or discontinue the Service or any part of it at any time, but we’ll try to give reasonable notice when feasible.

2. Accounts

You must create an account to use the Service. You are responsible for all activity under your account and for keeping your login credentials secure. Notify us promptly if you suspect any unauthorized use of your account.

3. Use of the Service

You agree to use the Service only in compliance with these Terms and all applicable laws. You may not use the Service for unlawful purposes or in ways that infringe others’ rights.

We don’t claim ownership of your stream or data. You’re responsible for ensuring your use of Mobe complies with any third-party platform rules (e.g., Twitch, YouTube).

We may suspend or terminate your access if your use poses a security, operational, or legal risk, but we’ll act reasonably and case-by-case.

4. Your Data

We understand that your content and stream data are important to you. While Mobe processes portions of your stream in order to function, you remain the owner of all content you create. Our use of your data is limited to operating and improving the Service, analyzing usage, and supporting product development across our ecosystem.

• You retain ownership of your stream content at all times.
• By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, process, and transmit your content to operate, improve, analyze, and promote the Service, and to develop related products and features.
• You can request deletion or export of your data, subject to technical feasibility.
• We may collect usage data to understand trends, improve performance, and enhance the user experience.

5. Billing, Payment & Refunds

5.1 Fees and Payment

If you subscribe to a paid plan, you agree to pay all applicable fees and taxes. Fees are due at the start of each billing cycle, and you authorize us and our payment processor to charge your chosen payment method automatically.

5.2 Billing Cycle and Renewal

Subscriptions renew automatically at the end of each billing period unless canceled before renewal. You can cancel anytime through your account settings. Cancellation stops future renewals but doesn’t refund past payments unless required by law.

5.3 Free Trials and Promotions

We may offer free trials, promotional codes, or other temporary access to paid features. Trial durations and eligibility will be defined at the time of offer. At the end of a free trial, unless you cancel before it ends, your subscription will automatically convert to a paid plan and your payment method will be charged for the next billing period.

We may revoke or modify any promotional offer at our discretion.

5.4 Refunds

Except where required by law, all fees are non-refundable. Refunds, if any, are granted solely at our discretion.

5.5 Taxes

You are responsible for any taxes associated with your purchases, excluding our income taxes.

5.6 Late Payment

If payment fails or is overdue, we may suspend your access until payment is received.

6. Intellectual Property

All rights, title, and interest in and to the Service, excluding your content, belong to us or our licensors. You may not copy, modify, distribute, or sell any part of the Service.

If you provide feedback or suggestions, you grant us a perpetual, royalty-free right to use and incorporate them.

7. Disclaimer of Warranties

We provide the Service “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or use.

Our total liability for any claim related to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim (or $100 if you paid nothing).

Some jurisdictions don’t allow these limitations, so certain parts may not apply to you.

9. Safe-Harbor (Copyright)

While Mobe may process snippets of your stream, the Service isn’t a content-hosting platform. To the extent applicable, we comply with U.S. safe-harbor laws such as the Digital Millennium Copyright Act (DMCA).

If you believe your copyright has been infringed, send a notice including your contact information, the infringing material, and a statement made under penalty of perjury that you are the rights holder to:

10. Modifications

We may modify these Terms from time to time. Updates take effect when posted, and we’ll provide notice if material changes are made. If you continue to use the Service after changes, you agree to the updated Terms.

11. Termination

You may stop using the Service at any time.

We may suspend or terminate your account if you violate these Terms or use the Service in a way that could cause harm. Upon termination, your right to use the Service ends immediately.

Sections 4–8, 10–12 survive termination.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Pennsylvania, excluding its conflict-of-law rules.

You and we agree that the courts in Allegheny County, Pennsylvania have exclusive jurisdiction over disputes related to these Terms.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vokamancy, Inc. regarding the Service and supersede any prior agreements.
